These Terms of Service ("Terms") govern your access to and use of the FYTCO Logistics Portal and related services (the "Portal") provided by FYTCO Group ("FYTCO", "we", "us", or "our"). By creating an account or using the Portal, you agree to be bound by these Terms. If you do not agree, do not use the Portal.
1. Eligibility & Accounts
You must be at least 18 years old and able to form a binding contract to use the Portal. When you register, you agree to provide accurate information and to keep your account credentials confidential. You are responsible for all activity under your account. We verify ownership of your email address through a Double Opt-in confirmation during registration.
2. Description of the Service
The FYTCO Logistics Portal provides cloud-based supply chain visibility and management tools, including real-time shipment tracking, customs clearance alerts, delivery confirmations, and exception notifications. We may modify, enhance, or discontinue features from time to time and will provide reasonable notice of material adverse changes.
3. Transactional Email Consent
By creating an account and using the FYTCO Logistics Portal, you expressly consent to receive transactional emails that are necessary for the operation, functionality, and security of the Portal. These messages include, but are not limited to: account registration and verification confirmations (Double Opt-in), password reset instructions, shipment status updates, customs clearance notifications, delivery confirmations, and critical security or service alerts.
These communications are not marketing or promotional messages. They are triggered by your actions or by events on your shipments, or are essential to providing the service you have requested. Because certain notifications are required to maintain the security and integrity of your account, the ability to unsubscribe from them may be limited. FYTCO does not send unsolicited marketing or bulk email, and our delivery infrastructure is integrated with Amazon SES and SNS to automatically process bounces and complaints and suppress invalid addresses.
4. Acceptable Use
You agree not to use the Portal to transmit spam, unsolicited bulk messages, malware, or unlawful, fraudulent, or infringing content; to impersonate others; to attempt unauthorized access to the Portal or its systems; or to interfere with platform operation. You are solely responsible for the lawfulness and accuracy of the shipment and customs information you process through the Portal.
5. Fees & Billing
Paid plans are billed in advance on a recurring monthly basis unless otherwise stated. You authorize us to charge your designated payment method for applicable fees. You may cancel at any time; access continues through the end of the current billing period. Except where required by law, fees are non-refundable. We may change pricing with reasonable advance notice.
6. Your Content & Data
You retain ownership of the data and content you submit to the Portal. You grant us a limited license to host and process that content solely to operate and provide the service. Our handling of personal data is described in our Privacy Policy.
7. Suspension & Termination
We may suspend or terminate accounts that violate these Terms, pose a security risk, or are used unlawfully. You may terminate your account at any time. Upon termination, your right to use the Portal ends, and we will handle your data in accordance with our Privacy Policy and applicable law.
8. Disclaimers
The Portal is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the service will be uninterrupted, error-free, or completely secure.
9. Limitation of Liability
To the maximum extent permitted by law, FYTCO shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising from or related to your use of the Portal. Our aggregate liability shall not exceed the amounts you paid to us in the twelve months preceding the claim.
10. Governing Law
These Terms are governed by the laws of the Kingdom of Saudi Arabia, without regard to conflict-of-laws principles. Any disputes shall be subject to the competent courts of Jeddah, Saudi Arabia.
11. Changes to These Terms
We may revise these Terms from time to time. Material changes will be communicated through the Portal or by transactional email. Your continued use of the Portal after changes take effect constitutes acceptance of the revised Terms.
